Course Aims & Objectives : AimsTo introduce students to the socio-economic environment of E-Commerce from the legal standpoint. To develop an understanding of the substantive rules of law relating to enforceability of electronic agreements and validity of digital signatures and to focus on current issues such as right to privacy, consumer rights, and intellectual property rights as it relates of E-Commerce. To develop an understanding of jurisdictional or trans border issues arising from electronic transactions. Objectives On completion of this course: Students should be able to show an understanding of the basic principles of the law relating to electronic agreements and digital signatures, right to privacy, consumer rights and intellectual property rights as it relates to E-Commerce. Students should be able to understand that many electronic transactions involve transborder issues. Units: 3 Level: P5 Medium of Instruction: EnglishKeyword Syllabus: - The nature of contracts made by electronic means and the similarities and differences between such contracts and other contracts. - Enforceability of electronic contracts. - Electronic payment system and the law. - Principles of privacy law affecting electronic transactions. - The question of the protection of the consumer. - Electronic commerce and intellectual property rights. - Misrepresentation including negligent misrepresentation and deceit. - Defamation law and electronic transactions. - Vicarious liability and electronic transactions. - Breach of the Electronic Transactions Ordinance. - Jurisdictional issues arising from electronic transaction. Teaching Pattern: Duration of course: 3 hrs Seminar per week (total 39 hrs) (Group Size: 50) Assessment Pattern: Examination duration: 3 hours Percentage of coursework, examination, etc: 30% Coursework ; 70%ExaminationGrading pattern: Standard (A+AA-...F)A student must obtain a minimum mark of 30% in both coursework and examination and an overall mark of 40% in order to pass a course.Pre-requisite(s): Nil Pre-cursor(s): Nil Equivalent Course(s): Nil
